Welcome to Cyber Unicorns(we, us, our). These Terms & Conditions (Terms) govern your access to and use of cyberunicorns.com.au, including our cybersecurity education and online safety platform and any content, courses, learning materials, events, or services provided through it (the Platform) and the related Cyber Unicorns mobile application on both iOS and Android platforms.

By accessing or using the Website or Platform (including visiting pages, creating an account, downloading resources, or enrolling in courses), you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Who We Are

Cyber Unicorns Pty Ltd (ABN: 37670671486) provides cybersecurity education and online safety content for individuals, families, schools, and organisations in Australia and abroad.

2. Acceptance of Terms

Binding agreement: Your use of the Platform constitutes acceptance of these Terms. If you create an account or click to accept during sign-up, that is additional confirmation.

Updates: We may update these Terms periodically. The latest version will be posted here with an effective date. Continued use after changes means you accept the updated Terms.

3. Eligibility & Accounts

Age:If you are under 18, you must have a parent/guardian's consent to use the Platform. We may offer age-appropriate experiences and require parental controls or school-administered accounts consistent with Australian online safety expectations.

Account security:Keep your login credentials confidential. You're responsible for all activity under your account and must notify us immediately of any unauthorised use.

Accuracy: Provide accurate information and keep it up to date.

4. Our Content & Intellectual Property

Ownership: All content on the Website and Platform—including text, lessons, videos, audio, graphics, logos, course materials, assessments, PDFs, and other resources—is owned by Cyber Unicorns (or our licensors) and is protected by Australian copyright law. Copyright arises automatically upon creation; no registration is required.

Your licence to use:We grant you a personal, non-exclusive, non-transferable licence to access the Platform and use content solely for your own learning (or your school/organisation's internal training if your plan allows), subject to these Terms.

No commercial use / no redistribution: You must not copy, reproduce, adapt, publish, distribute, sell, sub-licence, or otherwise exploit our content without prior written permission. Australian law gives copyright owners exclusive rights to reproduce, communicate, publish and adapt works.

Trademarks: Our names, logos, and brand elements are protected. Do not use them without permission.

5. User Content (Comments, Assignments, Uploads)

Your rights: You retain ownership of content you submit (e.g., forum posts, assignments).

Licence you give us: By submitting content, you grant Cyber Unicorns a non-exclusive, royalty-free licence to use, host, reproduce, adapt, and display that content for Platform operations, moderation, and to improve our services.

No infringing content: Do not submit content that infringes third-party rights, is unlawful, harmful, or breaches these Terms.

6. Acceptable Use

You agree not to:

  • misuse the Platform (e.g., upload malware, attempt to bypass security, or disrupt learning);
  • harass, bully, or abuse others (including minors); share or solicit sexual, violent, or unlawful material; or encourage self-harm;
  • share answers or materials to enable cheating or infringe privacy; use the Platform for advertising or unsolicited messages.

We may suspend or terminate accounts that breach these rules.

We aim to align with Australia's Basic Online Safety Expectations (BOSE) by taking reasonable steps to help keep users safe, including reporting, moderation, age-appropriate experiences, and cooperation with relevant providers/regulators.

7. Privacy & Data

Privacy Act & APPs: If we collect personal information (e.g., names, emails, learning progress), we handle it in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). See our Privacy Policy for details (collection, use/disclosure, security, access/correction, direct marketing, and cross-border disclosures).

Children's data:We apply additional care for minors' data and safety consistent with eSafety guidance.

8. Communications & Marketing

Consent required: We may send emails/SMS about courses, updates, and offers. We comply with the Spam Act 2003—we only send commercial electronic messages with valid consent, we identify ourselves clearly, and include a functional unsubscribe.

You can change your preferences or unsubscribe at any time via the link in our messages.

9. Education & Safety Disclaimers

No professional advice: Our content is educational and aims to improve cybersecurity awareness and skills. It is not legal, professional, or emergency incident response advice.

Accuracy: While we strive for accuracy, cybersecurity evolves rapidly. Content may not reflect latest threats or standards at all times; please use professional judgment and up-to-date sources.

Third-party links/tools: If we reference third-party resources, you use them at your own risk.

10. Australian Consumer Law (ACL)

Nothing in these Terms excludes or limits any consumer guarantees or rights under the ACL that cannot be excluded.

11. Fees, Enrolments & Refunds (if applicable)

Pricing & enrolment: Any fees for courses, subscriptions, or certifications will be shown at checkout.

Billing: You authorise us (or our payment processor) to charge your selected payment method for applicable fees.

Refunds: Our refund policy complies with the ACL consumer guarantees (e.g., where services are not provided with due care and skill or as described).

12. Availability & Changes

We may modify, suspend, or discontinue any part of the Platform (including courses or features) with notice where practicable. We're not responsible for outages, maintenance windows, or events beyond our control.

13. Termination

We may suspend or terminate your access immediately if you materially breach these Terms, harm other users, or infringe our IP. You may stop using the Platform at any time. Termination does not affect accrued rights.

14. Liability

Limits: To the maximum extent permitted by law, Cyber Unicorns is not liable for indirect or consequential loss, loss of profits, or data loss arising from use of the Platform.

This clause is subject to the ACL and does not limit any non-excludable rights or remedies.

15. Schools & Organisations

If you're a school or organisation:

  • You are responsible for appropriate supervision, safeguarding, IT configurations, and policies (including device management, content filtering, and incident handling).
  • We can provide educator resources and align with eSafety's best-practice frameworks for online safety education.
  • Please contact us for onboarding support if that is required.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts in Queensland and courts of appeal.
